Privacy Policy

1. Introduction

Julia Martha Handford (trading as Julia’s Celebrant Agency) ABN 41 032 797 422 (“we”, “us”) is an online platform for locating and interacting with marriage celebrants (“Service”).

Our registered marriage celebrants (“Celebrant”) share their professional identities and post relevant content to advertise their business to our customers (“Customer”) who are able to view that content and interact with those Celebrants including by engaging a Celebrant to perform their marriage. We facilitate the booking process by allowing the Customer to book the Celebrant via our Service public. (“Public”).

2. Parties

Our Privacy Policy applies to each Celebrant, Customer and the Public that uses the Service or accesses the Website.

We will refer to Celebrants, Customers and the Public as “you”.

You must have attained the age of 18 years to use the Service.

3. Acceptance of Privacy Policy

You acknowledge and agree that by clicking “I Agree”, “Join JCA”, “Yes” or similar, you confirm that you have read this Privacy Agreement and consent to the collection of your personal information (as defined herein) as prescribed by the Privacy Policy and the User Agreement (if any).

4. Conflict between Privacy Policy and User Agreement

To the extent that there is a conflict between the terms of this Privacy Policy and the User Agreement entered into between you (Celebrants) and JCA, the terms of the User Agreement have precedence.

5. Changes to Privacy Policy

We may change this Privacy Policy from time to time and, if we do so, we will inform you of the amendments.

If you do not agree to any of the changes to the Privacy Policy you must cease to use the Service.

You acknowledge and agree that continued use of the Service after receiving notice of any amendment constitutes acceptance of the Privacy Policy as amended.

6. Types of Information we collect

6.1 Introduction

We collect information (including your personal information) and content when you use our Services whether or not you are a Celebrant, Customer or member of the Public.

The types of personal information that we collect and hold will vary depending on your dealings with us. This information may include any or all of the following:

  • Names, addresses, telephone numbers and other contact details;
  • Email addresses;
  • Payment information;
  • Other personal information required to provide our Service;
  • Transaction details in relation to your usage of the Service; and
  • Any information and content you upload, post, submit, vary, or otherwise communicate or make known via our Service.

We will not use your personal information for any other purpose without first seeking your consent, unless we are authorised or required to do so by law.

  • to establish and maintain your relationship with us;
  • to provide the Service you have requested from us;

  • you should not register as a Celebrant;
  • you should not visit our website; and
  • you should not otherwise use our Services; and
  • if you have already registered, you can and should close your account.

You acknowledge and agree that we may collect your personal information in the following ways described hereunder.

6.2 Registration for Celebrants

When you create an account with us, we collect your personal information (such as your name, email address, and password). You may elect to provide us with further information. You acknowledge and agree that we and others will be able to identify you by your personal information.

6.3 Profile Information for Celebrants

We collect your personal information when you complete your profile.

You acknowledge and agree that:

  • any personal information, including any information and content on your profile may be submitted, posted, uploaded, added, made, shared or otherwise caused to be made available on, the Service;
  • that your personal information may be visible to other registered Celebrants and Customers and the public; and
  • that your profile information may include personal information about you such as your full name, address, telephone number, mobile number, and email address.

6.4 Availability

We collect personal information relating to your availability.

For example, when a booking is made, we may collect information relating to the booking including but not limited to: the date the booking was made, the booking fee paid, and the Customer’s details.

6.5 Customer Service

You acknowledge and agree that it is reasonable for us to require view and obtain this information in order to properly respond to your request for assistance and, if applicable, investigate any breach of this Privacy Policy or the User Agreement.

6.6 Cookies

We use cookies and similar technologies to identify you to us when you interact with the Service, to collect your personal information, track your usage of our Service and to better serve you when you revisit us.

For example, we may receive the IP Address of your computer or the proxy server that you use to access the web, your computer operating system details, your type of web browser, your mobile device (including your mobile device identifier provided by your mobile device operating system), your mobile operating system, and the name of your ISP or your mobile carrier.

  • personalise the information you receive when you view the Service;
  • detect the type of activity you conduct on the Service; and

Anonymous information is also generated whenever a page is accessed on our website that records information such as the time, date and page accessed. We may use such information for statistical and maintenance purposes.

You may refuse cookies by disabling them in your browser, however, for our Service to fully function you must have cookies enabled.

We collect your personal information when you visit our Services and interact with advertising on and off our Services.

For example, we collect information when you view or click on ads on and off our Services, perform a search, post, view or share content and make a booking.

We may display advertising on, beside, above, below, or as a banner, notice, or pop-up, in relation to your content, including your profile.

Any use of our Service creates information relating to its use and your interaction with it. To the extent that such information includes personal information also collect and use this information.

7. How we use your personal information

7.1 Consent to us using Information About You

You agree that any personal information you provide on your profile can be seen by others and used by us as described in this Privacy Policy.

The personal information that you provide to us may reveal or allow others to identify aspects of your life that are not expressly stated on your profile (e.g. your name may reveal your gender).

By providing personal information to us when you create or update your account and profile, you are expressly and voluntarily accepting the terms and conditions of our User Agreement and freely accepting and agreeing to our processing of your personal information in ways set out by this Privacy Policy. Supplying to us any information is entirely voluntary on your part.

If you post, share, or comment on a profile or other part of the Service, others may see your personal information related to that communication which may include the content of the communication and the identity of the person making the communication.

For example, when you sign in to your account, we may inform you of Celebrants or Customers in your area.

7.5 Sharing Celebrant Information with Third Parties

Any personal information you put on your profile and any content you post, share, comment, or otherwise create on the Service may be seen by others.

We may share your personal information with third parties pursuant to this Privacy Agreement, the User Agreement, with your consent or as required by law. We will always let you know when we make significant changes to this Privacy Policy.

We note that any personal information made available via the Service may be visible to the public via search engines.

For example, comments you make via the Service or your profile may be indexed and displayed through public search engines when someone searches for your name.

You acknowledge and agree that even if you delete your account, your Information may remain cached by third-party search engines and that in making your personal information available via the Service that information may be remain available to the world at large.

We do not rent or sell your personal information that you have not posted, shared, commented, or otherwise made available on our Services, except as described in this Privacy Policy.

We will not disclose your personal information that you have not posted, shared, commented, or otherwise made available on our Services, except to carry out your instructions ( process payment of a Booking Fee) or unless we have your consent.

We may disclose any and all your personal information if we believe that disclosure is permitted or required by law.

7.6 Search

Our Services help you search for Celebrants. You may also be able to search for other Customers, information about weddings, and other information. We use your personal information to inform and refine our search service.

7.7 Dealing with your Content

You are responsible for any information (including any personal information) you post, share and comment or otherwise create via our Service, and you should be aware that any information you choose to so disclose can be read, collected, and used by other Celebrants, Customers, and third parties.

We are not responsible for the personal information you post, share, comment or otherwise create via the Service. Some or all of that information may be public and searchable on the Internet and, even if you delete your account, others may have copied and used the information that you shared.

We may remove any of your personal information or other content or communications made via the Service at any time and whether or not that removal is required by law.

7.8 Testimonials

If you provide any testimonials about our Services you expressly authorise us to:

  • edit or make formatting changes to the testimonials, provided always that the meaning of the expression remains unchanged;
  • publish those testimonials in connection with our promotion of the Service; and
  • to include your name and other personal information that you have provided.

7.9 Pages for Celebrants and Other Entities

Celebrants and other entities can create pages on our Service. You may have the option to ‘follow’ one of these pages. If you do so, certain personal information about you may be provided to the owner of the page and you will be listed among its followers, which can be viewed by others. We use information about followers and viewers to (among other things) compile and provide data about such pages’ performance.

7.10 Disclosure of Information

We may disclose your personal information if compelled by law, if we reasonably believe we are required to disclosure that information or if necessary to enforce our User Agreement.

You acknowledge and agree that if your personal information is disclosed for any of the above reasons, we are not liable for any loss, damage or other injury you may suffer and you indemnify us in relation to the same. You acknowledge and agree that we are not obliged to challenge any demand made for your personal information made by a law enforcement agency or other body which may compel us to produce information by law.

We may also disclose your personal information to third parties for business purposes (e.g. relation to the sale of the Service). You acknowledge and agree that if the Service is sold, the purchaser of the Service may receive your personal information and deal with your personal information in accordance with the User Agreement and this Privacy Policy.

7.11 Service Providers

We may employ third party companies and individuals to provide, manage and otherwise facilitate our Service (e.g. maintenance and development). These third parties may have access to your personal information to perform these tasks on our behalf but will be otherwise obliged to keep such information confidential. You acknowledge and agree that we cannot be held liable for any failure of these third parties to keep your personal information confidential whether by negligence, wilful disclosure, breach of security or otherwise. You acknowledge and agree that we may choose not topursue any third party for such disclosure in our absolute discretion and you will indemnify and keep us indemnified in relation to any loss, damage, or other injury you may suffer in relation to the same.

7.12 Data Processing Outside Your Country

You acknowledge and agree that we may process your personal information outside Australia. The country where your personal information is processed may not have the same or substantially similar privacy laws as the ones governing this Privacy Policy in Australia and accordingly, your personal information stored in those countries may not receive the same protections that it would receive were it to be stored in Australia. You may request that we do not transfer your data outside Australia and, if you do so, we may be unable to provide the Service to you.

8. Your Choices & Obligations

8.1 Rights to Access, Correct, or Delete Your Information, and Closing Your Account

You can change your personal information at any time by editing your profile, deleting content that you have posted, or by closing your account.

If you request us to close your account, you acknowledge and agree that:

  • the deletion process may take up to sixty (60) days;
  • personal information you have shared with others or that others have copied may also remain visible after you have closed your account or deleted the information from your own profile;
  • you may not be able to access, correct, or eliminate any information about you that other Celebrants, Customers or the Public have copied, shared, or otherwise dealt with out of our Services and that this information may not be in our control; and
  • your public profile may be displayed in search engine results until the search engine refreshes its cache or indefinitely.

8.2 Data Retention

We keep your personal information for as long as your account is active or as needed, whichever is the earlier. We are not providing you with a storage service.

For example, we may keep certain information even after you close your account if it is necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce this Privacy Policy or the User Agreement.

We store your personal information in computer systems, storage facilities, hard copy (paper) files and other means. Whilst we will make reasonable endeavours to protect your personal information from being dealt with otherwise that in accordance with this Privacy Policy you acknowledge and accept that the internet is not a secure method of transmitting or storing information and that we cannot and do not accept any responsibility for the security of any information or content that you choose to send to or receive from us or the Service, or users of the Service, or any unauthorised access or use of that information by any person.
